Transvaginal Mesh Lawsuits Move Forward, As Bernstein Liebhard LLP Notes New Order in Federal Boston Scientific Litigation

According to the December 11th Order, the Court has denied a Motion to Stay Enforcement of Plaintiffs’ Subpoena filed on behalf of a biomedical materials supplier to Boston Scientific. The Order further directs the company in question to produce the majority of documents sought by plaintiffs no later than January 10, 2014. Any responsive documents located thereafter shall be supplied to Plaintiffs no later than January 20, 2014. Transvaginal Mesh Lawsuits
Court documents indicate that Boston Scientific is facing more than 7,800 transvaginal mesh lawsuits that have been filed in the litigation underway in the Southern District of West Virginia. The first bellwether trial in the proceeding is scheduled to begin on March 10, 2014. The second bellwether case will go to trial on July 13, 2014. All of the claims pending in the litigation allege that pelvic mesh products marketed by Boston Scientific were defectively designed and manufactured, and caused recipients to suffer serious vaginal mesh complications, including mesh erosion and shrinkage, pain, infections, scarring and organ damage.
Boston Scientific is just one of several pelvic mesh manufacturers involved in litigations now underway in the Southern District of West Virginia. Bernstein Liebhard LLP partner, Jeffrey S.
