Transvaginal Mesh Lawsuits News: AMS, Boston Scientific Bellwether Trials Planned for Early 2014, Rottenstein Law Group LLP Reports
(PRWEB) October 31, 2013 -- Bellwether trials of American Medical Systems (Endo) and Boston Scientific transvaginal mesh lawsuits in federal court in West Virginia are scheduled to begin in spring 2014, according to court documents. The first bellwether trial in the American Medical Systems consolidation will begin on April 7, 2014, according to court documents (American Medical Systems; MDL-2325, U.S. District Court for the Southern District of West Virginia). The first in the Boston Scientific consolidation will begin on March 10, 2014 (American Medical Systems; MDL-2325, U.S. District Court for the Southern District of West Virginia). The court documents note that, should those cases be settled prior to trial or are not ready, then a second bellwether trial involving a different lawsuit will proceed.
“Bellwether trials are chosen to proceed first because their characteristics indicate they could serve to forecast outcomes of other trials in a consolidation of cases,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “With these vaginal mesh multidistrict litigations, there are thousands of lawsuits whose pretrial proceedings were consolidated. So it is important for the parties involved that they get an idea of how juries will decide these cases, if and when they go to trial.”
There are more than 10,000 transvaginal mesh lawsuits in the AMS MDL and more than 6,000 in the Boston Scientific MDL, respectively, according to court documents. AMS and Boston Scientific are among five of six major mesh manufacturers who are considering settling tens of thousands of mesh lawsuits across the nation, according to a Sept. 30 Bloomberg report.* AMS has already settled more than $50 million in transvaginal mesh lawsuits this year, according to Bloomberg.
Women are filing transvaginal mesh lawsuits alleging they suffered from serious adverse side effects such as pain, discomfort, and device erosion, according to court documents. Vaginal mesh products were designed to enable doctors to treat pelvic organ prolapse and stress urinary incontinence.
