Upcoming Webinar from WPL Publishing to Examine Pacing Delays in Construction

Webinar speakers will identify, define, and discuss pacing delays as well as address a contractor’s right to create a pacing delay, a relatively new form of delay in the construction industry. Webinar attendees also will learn the practical impact of a pacing delay, both to a project and to a contractor’s delay claim. There is a limited amount of literature on the topic of pacing delays, and case law is sparse. As a result, owners and contractors have often found themselves at odds with one another over the right to pacing delay and the practical effect of pacing delays in delay claim situations. Among other things, the webinar, entitled “Pacing Delays: The Practical Effect on Construction Projects and Delay Claims,” will do the following:
- Define what a pacing delay is in construction.
- Explain how owners and contractors cause pacing delays.
- Outline the risks and benefits associated with pacing delays.
- Discuss how pacing delay claims are impacted by concurrent delay and float consumption arguments.
- Explain how pacing delay may result in less delay recovery for contractors.
Addressing webinar attendees will be Navigant Construction Forum Executive Director James Zack and William Freeman, an associate director in Navigant Consulting Inc.’s Atlanta office.
Mr. Zack once served as executive director of Corporate Claims Management for Fluor Corp. He also held the position of vice president at PinnacleOne and senior construction claims consultant at CH2M Hill Inc. With more than 40 years of experience, he is a recognized expert in mitigation, analysis, and resolution or defense of construction claims. He is a certified forensic claims consultant, a certified construction manager, and a project management professional.
Mr. Freeman has more than 17 years of experience in construction management services. His expertise covers project management, contract administration, claim analysis, dispute resolution, and litigation support for various complex engineering, construction, and information technology projects. He has been retained by owners, contractors, and subcontractors to provide expert consulting services on commercial, institutional, and industrial projects. He has participated in numerous settlement conferences, mediations, and arbitrations.
After the presentations, there will be an interactive 10-15 minute question-and-answer session addressing relevant topics.
