Vaginal Mesh Lawsuit News: Federal Judge Orders 200 Transvaginal Mesh Lawsuits be Selected for Discovery in C.R. Bard Litigation, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) January 26, 2014 -- The federal judge overseeing thousands of vaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/) filed against C.R. Bard, Inc. in the U.S. District Court, Southern District of West Virginia, has ordered the parties to work up 200 claims for discovery, as well as dispositive motions where appropriate, Bernstein Liebhard LLP reports. According to the January 16th Order, attorneys for plaintiffs and the defense are to select 100 cases each, so that U.S. District Judge Joseph R. Goodwin may ready those lawsuits for trial, either in the Southern District of West Virginia, or plaintiffs’ home districts. (In re C.R. Bard Inc. Vaginal Mesh Lawsuits
Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, is serving on the Plaintiffs' Steering Committee in the federal C.R. Bard litigation. According to court documents, more than 6,500 claims have been filed in the proceeding on behalf of women who suffered painful transvaginal mesh complications, allegedly due to the company’s Avaulta pelvic mesh devices.
Court records indicate that the first bellwether trial in the C.R. Bard litigation concluded in August, when the company was ordered to pay $2 million in compensatory and punitive damages to the Plaintiff. Court records further indicate that the vaginal mesh lawsuit selected for the litigation’s second bellwether trial settled on the day the trial was set to begin, while the third case set for a bellwether trial was voluntarily dismissed by the Plaintiff. Another bellwether trial was scheduled to begin on January 10, 2014, but it has been postponed indefinitely.
According to court documents, C.R Bard is named in more than 940 additional transvaginal mesh lawsuits that are pending in a multicounty litigation underway in New Jersey’s Atlantic County Superior Court. In addition to C.R. Bard, a number of other transvaginal mesh manufacturers are involved in litigations alleging injury due to their products. Mr. Grand is also serving on the Plaintiffs’ Steering Committees in several other federal proceedings underway in the Southern District of West Virginia, including In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; and In re: Ethicon, Inc. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327.
Mr. Grand has also been named Co-Liaison Counsel in a second consolidated proceeding underway in Atlantic County Superior Court for vaginal mesh lawsuits filed against Ethicon, Inc.
