Vaginal Mesh Lawsuit Settlement
According to court documents, the recently settled #vaginal mesh lawsuit was filed on behalf of a North Carolina woman who was implanted with Bard’s Avaulta Solo product to treat her pelvic organ prolapse. The Avaulta device allegedly caused her to suffer serious transvaginal mesh complications, leading to severe, permanent physical and emotional injuries. She further alleged that the device was defectively designed, and accused Bard of failing to warn of the potential risks associated with the mesh. (Queen v. C.R. Bard Inc., 11-cv-00012)
Many of her allegations were similar to those brought forth in the federal litigation’s first vaginal mesh trial, which Bard lost just a week prior. That transvaginal mesh lawsuit was filed on behalf of a woman who was injured by the Bard Avaulta Plus device, and who claimed that the company had knowingly used a plastic resin that was unfit for permanent implantation. According to court documents, the total judgment in that case included $250,000 in compensatory damages and $1.75 million in punitive damages. (Cisson v. C.R. Bard Inc., 11-cv-00195)
That trial marked the third loss in a row for transvaginal mesh manufacturers, and the second loss for C.R. Bard. Last July, the company was ordered to pay $3.6 million to another victim of Avaulta Plus in a case that went to trial in California Superior Court. (Scott v. Kannappan, S-1500-CV-266034-WDE ) In March, the New Jersey Superior Court jury hearing the nation’s first trial of an Ethicon Inc. transvaginal mesh lawsuit awarded more than $11 million to a woman injured by the Gynecare Prolift device.
