Wright Hip Lawsuit: Wright Profemur Hip Replacement Lawsuit Class Action Certified in Canada, Bernstein Liebhard LLP Reports

According to court documents, the Nova Scotia Supreme Court issued an Order on March 7, 2014, that certified a class action lawsuit brought on behalf of Canadians who allegedly suffered painful and debilitating complications due to the Profemur hip. Plaintiffs in the Wright Profemur hip lawsuit claim that their metal hip stem fractured within just a few years of implantation. Among other things, they assert that at least 630 fractures involving the Wright Profemur hip replacement have been reported in Canada. The case is expected to go to trial sometime in 2016. According to court documents, a number of Wright hip lawsuits have been filed in the U.S. on behalf of patients who are also alleged to have suffered injuries due to the Profemur system. These include a case that was settled in December 2013, just before it was scheduled to go to trial in the U.S. District Court, Middle District of Georgia this past December. (Courson, et ux. v. Wright Medical Technology, Inc., No. 5:12-cv-173) Court papers filed in March 2013 in U.S. District Court, Northern District of California indicated a settlement had also been struck in a similar claim that was pending in that jurisdiction. Court documents filed in the U.S. District Court, Northern District of Georgia indicate that the Wright Conserve Hip System has been named in more than 70 product claims pending in a multidistrict litigation now underway in that jurisdiction. All of these Wright hip lawsuits claim that the Conserve’s metal-on-metal design can cause the device to shed dangerous amounts of metal ions into recipients’ tissue and blood stream. Plaintiffs further allege that this occurrence can result in metallosis, pseudotumor formation, failure of the hip, and other serious complications.
