Through the initial transfer order*, the Panel approved the consolidation of twenty-one Xarelto lawsuit actions originating from 10 district courts spanning Florida, Illinois, Kentucky, Louisiana, New York, Utah, Vermont, and West Virginia. The cases have been transferred to the Eastern District of Louisiana for pretrial proceedings. Plaintiffs in the initial Xarelto lawsuit actions suggested a wide range of transferee courts, according to the Transfer Order, including District Courts in Alabama, Colorado, Illinois, Florida, Georgia and New York in addition to Louisiana. The defendant opposed centralization, arguing that individual details regarding plaintiffs’ medical histories made consolidation unfavorable, but suggested New Jersey as the transfer court should centralization move forward, according to court documents.
While differing medical histories were taken into account, the Judicial Panel on Multidistrict Litigation ultimately determined that the overriding commonalities of the cases made consolidation a practical choice, according to the transfer order. Specifically, the common issued cited include “the adequacy of Xarelto’s warning label with respect to the risk of severe bleeding and other injuries, the results of certain clinical studies, and the alleged need for blood monitoring”, according to the transfer order, on official court document.
In opposing consolidation, the defendant asserted that Xarelto lawsuit claims lack merit, and that consolidating the claims as an MDL would prompt many more persons to file “voluminous claims without due diligence”, according to the transfer order. In response, the panel suggested that consolidation better facilitated the processing of “spurious claims”, according to the court documents. Ultimately, the panel deemed multidistrict litigation would result in expediency and convenience for processing Xarelto lawsuits, according to court documents.
