Xarelto Lawsuit Plaintiffs Counter Opposition to Proposed Multidistrict Litigation, Bernstein Liebhard LLP Reports

According to court documents, Bayer Healthcare and Johnson & Johnson’s Janssen Pharmaceuticals unit have asserted that the proposed consolidation is inappropriate because the pending lawsuits are too individualized. But in a brief submitted to the U.S. Judicial Panel on Multidistrict Litigation (JPML) on November 7th, plaintiffs point out that all of the complaints raise common questions about the companies’ marketing materials for Xarelto, particularly claims that the drug is superior to warfarin because it does not require patients to undergo regular blood monitoring. Xarelto Lawsuit Allegations
Court records indicate that at least 30 Xarelto lawsuits have been filed in U.S. courts on behalf of individuals who suffered uncontrollable bleeding and other serious complications allegedly linked to its use. Among other things, plaintiffs assert that the manufacturers of the medication should have recommended blood monitoring for patients, so that physicians could adjust dosage to avoid high concentrations that have the potential to lead to life-threatening internal hemorrhaging. The lawsuits also point out that there currently exists no approved antidote for Xarelto bleeding. By contrast, the bleeding that can occur with warfarin can be stopped via the administration of vitamin K.
In October, a number of Xarelto lawsuit plaintiffs asked the JPML to consolidate all federally-filed claims before a single judge in the U.S. District Court, Southern District of Illinois for coordinated pretrial proceedings. According to court documents, the plaintiffs assert that hundreds of cases involving similar allegations could eventually be filed, and that centralization of the docket would allow the Xarelto claims to proceed more efficiently through the court system. The JPML is scheduled to hear Oral Arguments on the matter on December 4, 2014.
